Terms and Conditions of Use

These Terms and Conditions of Use govern the use of the Thrift Kosova platform, including the website, mobile applications and any other digital service operated by Thrift Kosova L.L.C.
By creating an account, visiting or using the Platform, listing an item for sale, placing an order or using any Thrift Kosova service, you agree to these Terms.
If you do not agree to these Terms, you must not use the Platform.
01About Thrift Kosova
Thrift Kosova is an online platform that enables users to list, discover, buy and sell items between one another.
Unless expressly stated otherwise, Thrift Kosova does not own the items listed by sellers and is not itself the seller of those items.
The contract for the sale of an item is entered into between the seller and the buyer. Thrift Kosova provides the digital infrastructure and may provide or arrange supporting services such as payments, delivery, verification, dispute handling and other Platform functions.
Thrift Kosova may be a separate contracting party for services that the Platform itself provides to users.
02Who May Use the Platform
You must be at least 18 years old to create an account, list items, buy or sell through Thrift Kosova.
By using the Platform, you represent that you are 18 years of age or older and that you have the legal capacity to enter into contractual relationships.
Thrift Kosova may request information or documentation to confirm your age, identity or other information where necessary for security, fraud prevention, payments, legal compliance or operation of the Platform.
03User Accounts
Users are responsible for the accuracy of the information provided in their account and for maintaining the security of their login credentials.
You may not use another person's identity, create fraudulent accounts, use the Platform on behalf of another person without authorization or use multiple accounts to circumvent Platform restrictions.
You must notify us if you suspect that your account has been compromised or used without authorization.
04Who May Sell
Any user who meets the Platform requirements may list items for sale.
Sellers may be private individuals or persons engaged in business, commercial or professional activity.
If a seller acts in the course of a business or professional activity, they are responsible for complying with all legal obligations applicable to them, including, where relevant, obligations relating to consumer protection, buyer information, invoicing, taxation, returns, guarantees and other consumer rights.
A buyer's rights may differ depending on whether they purchase from a private seller or from a seller who is legally considered a “trader.” Kosovo Consumer Protection Law defines consumers and traders on the basis of this distinction.
Thrift Kosova may require a seller to declare whether they are acting as a private individual or as a trader and may display that status on the Platform.
05Seller Verification
Verification is not mandatory in order to be a seller on Thrift Kosova.
A user may apply for a verified profile by submitting an identification document and any information requested by Thrift Kosova.
Following review and approval, the Platform may display a “verified” badge or similar indicator on the user's profile.
“Verified” status only means that Thrift Kosova has completed the applicable identity-verification process. It does not guarantee the quality, authenticity, condition, legality or description of any item listed by that user and does not constitute a recommendation or guarantee by Thrift Kosova.
Thrift Kosova may remove verified status where it has reasonable grounds to believe that the information is no longer accurate or where the user breaches these Terms.
06Listing Items
Listing an item on Thrift Kosova is free of charge.
The seller is responsible for all information published in relation to an item, including photographs, description, brand, size, condition, defects, authenticity and any other relevant characteristics.
The seller must ensure that all information is accurate, complete and not misleading.
Any defect, damage, alteration or material characteristic that a reasonable buyer would consider important must be clearly disclosed.
The seller represents that they have the legal right to sell the item.
An item must not remain actively listed on the Platform if it is no longer available.
07Prohibited Items and Activities
The listing, sale or attempted sale of counterfeit goods, stolen goods, unlawful goods, items the seller does not have the right to sell, as well as items presented through materially false or misleading information, is prohibited.
The Platform must also not be used for fraud, money laundering, payment abuse, manipulation of Platform systems, fee avoidance, infringement of intellectual-property rights or any other unlawful activity.
Thrift Kosova may remove or disable an item without prior notice where it has reasonable grounds to believe that the item breaches these Terms or applicable law.
The fact that an item is visible on the Platform does not mean that Thrift Kosova has inspected, certified or guaranteed it.
08Prices and the 12% Fee Model
The seller determines the amount they wish to receive from the sale (the “Seller Amount”).
Thrift Kosova does not charge a fee for listing an item.
The Platform automatically adds 12% to the Seller Amount. This 12% represents the Platform service amount and is included in the item price displayed to the buyer.
For example, if the seller determines that they wish to receive €100, the item will be displayed to the buyer at a price of €112. If the transaction is successfully completed and there is no refund, cancellation or other legal obligation affecting the payment, the seller receives €100.
The 12% amount is not added as an unexpected additional charge at checkout; it is already included in the item price shown to the buyer before purchase.
In addition to the item price, the buyer currently pays a standard delivery fee of €2 per order/delivery, depending on the way delivery is implemented by the Platform.
The total amount payable by the buyer must be clearly displayed before the buyer confirms the order. Kosovo law requires the price and relevant additional costs to be made clear to the consumer before the contract is concluded.
Thrift Kosova may change fees for future transactions, but any change must be clearly communicated to the user before they enter into a transaction and will not retroactively change the price of an order that has already been completed.
09Orders and the Sale Contract
When a buyer begins the purchasing process, they submit a request to purchase the item based on the information and price displayed on the Platform.
The steps required to confirm the order, the order status and the point at which the transaction becomes binding will be clearly presented during the checkout process and in the electronic order confirmation.
Thrift Kosova will provide the necessary means for identifying and correcting relevant input errors before the order is completed, in accordance with applicable requirements for electronic contracts. Kosovo's Law on Information Society Services contains specific requirements regarding the information that must be provided before an electronic order is placed.
If an item is no longer available, the transaction may be cancelled and any amount already paid will be handled in accordance with the applicable payment/refund policy and applicable law.
10Payments and Wallet
Available payment methods will be displayed on the Platform during checkout before the buyer completes the order.
Electronic payments may be processed by an authorized third-party payment service provider. Where applicable, the user may also be subject to the terms and conditions of that provider.
The Platform provides a “Wallet” function. The way in which the Wallet is credited, the time at which funds become available to the seller, withdrawal methods and any applicable restrictions will be presented on the Platform and in the relevant payment policy.
The use of the term “Wallet” does not in itself mean that Thrift Kosova is a bank, electronic-money institution or payment institution.
Thrift Kosova will not describe the funds as bank deposits or electronic money issued by Thrift Kosova itself unless the service has been lawfully structured and authorized as such.
The timing for release of funds, any applicable holding period and the payment service provider will be finalized before payments are activated.
This section is particularly important in light of the new Law No. 10/L-026 on Payment Services and the applicable regulatory framework of the Central Bank of Kosovo.
11Delivery
The buyer pays the standard €2 delivery fee unless a different amount is clearly disclosed before the order is placed.
Delivery may be carried out through one or more external transport operators or courier providers working with Thrift Kosova.
The seller must hand over the item for delivery in accordance with the instructions and timeframes displayed by the Platform.
The buyer must provide accurate and sufficient delivery information.
Specific rules regarding refused orders, failed delivery, incorrect addresses, failure by the seller to hand over the item, loss or damage during transit and return costs will be set out in the Delivery Policy before transactions are activated.
Nothing in this section limits any rights users may have under applicable law.
12Returns, Withdrawal, Refunds and Disputes
The buyer's rights depend, among other things, on the legal status of the seller and the nature of the transaction.
Where a seller is a private individual selling outside their business or professional activity, the provisions of Consumer Protection Law governing trader-to-consumer relationships may not apply in the same way.
Where the seller acts as a trader and the buyer is a consumer, mandatory consumer rights remain applicable. For distance contracts, Kosovo Consumer Protection Law generally provides for a 14-day withdrawal period, except where statutory exceptions apply.
Nothing in these Terms removes or restricts any mandatory legal right to a refund, return, conformity of goods, withdrawal from the contract or compensation.
For transactions where there is no mandatory legal right of return, any additional rights offered by Thrift Kosova will be set out in the Returns and Disputes Policy.
A buyer may be able to open a dispute on the Platform in relation to issues covered by the applicable policy, including where an item materially differs from its description, contains undisclosed damage, is the wrong item, is suspected of being counterfeit, has not been delivered or in other situations defined by the policy.
Where a dispute is opened, Thrift Kosova may, where necessary and permitted by law, temporarily suspend payment to the seller or processing of the transaction until the matter has been reviewed.
The deadline for opening a dispute, the evidence that may be required, the procedure for returning an item, responsibility for costs and the timing of refunds will be finalized in the applicable policy before purchases are activated.
13Communication Between Users
Thrift Kosova does not provide general private messaging between buyers and sellers.
Where communication is necessary to resolve a transaction-related issue, the Platform may allow communication through a dispute thread or another Platform-controlled channel.
Such communication may only be used for the purpose for which it was created.
Users may not use the Platform to exchange information for the purpose of completing a sale outside Thrift Kosova or to avoid the payment system, fees, delivery process or safety measures of the Platform.
14User Content
Users retain ownership of photographs, descriptions and other original content they publish.
By publishing content on the Platform, the user grants Thrift Kosova a non-exclusive, royalty-free license, applicable for as long as the content is reasonably necessary for operating or promoting the Platform, to store, display, reproduce, technically adapt and use that content in connection with listings, search, marketing and operation of Thrift Kosova.
The user represents that they have the necessary rights to any content they publish and that it does not infringe the rights of another person.
15Thrift Kosova Intellectual Property
The Thrift Kosova name, logo, visual identity, Platform design, software, text, graphics and other materials created or owned by Thrift Kosova are protected by applicable intellectual-property rights.
Users do not obtain ownership rights over these materials simply by using the Platform.
They may not be copied, republished, distributed, modified or commercially used without permission, except where permitted by law.
16Fraud Prevention and Security
Thrift Kosova may use automated or manual controls to detect fraud, suspicious activity, abusive use, suspicious payments, prohibited items or breaches of these Terms.
Where there are reasonable grounds to do so, Thrift Kosova may request additional documentation or information.
We may delay or restrict an action, transaction or payment to the extent necessary and legally permitted in order to investigate fraud, chargebacks, disputes, unlawful activity or security risks.
17Account Restriction, Suspension and Termination
Thrift Kosova may warn a user, remove a listing, restrict functionality, temporarily suspend or close an account in cases involving fraud, the sale of counterfeit or stolen goods, abuse of the system, payment abuse, attempted circumvention of the Platform, repeated violations, unlawful conduct or other serious breaches of these Terms.
Where reasonable and legally possible, the action taken will be proportionate to the nature of the breach.
Closing an account does not eliminate obligations that arose before the account was closed.
18Role and Liability of Thrift Kosova
Thrift Kosova provides a marketplace and does not necessarily manufacture, own or control the items listed by users.
The seller is responsible for the item, ownership of the item, its authenticity, condition and the accuracy of the listing.
Thrift Kosova does not guarantee that every user will complete a transaction or that every item is free from defects.
We will use reasonable care in providing our services.
To the maximum extent permitted by law, Thrift Kosova is not liable for losses arising directly from false information supplied by a user, unlawful conduct by a user or circumstances beyond the reasonable control of the Platform.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for Thrift Kosova's own acts or omissions where the law requires such liability.
19User Responsibility
The user is responsible for breaches of these Terms and applicable law resulting from their actions.
The seller remains responsible for claims arising from the fact that they did not have the right to sell an item, sold a counterfeit or unlawful item, provided materially false information or infringed the rights of a third party.
This provision does not create obligations for a consumer beyond those that may lawfully be imposed.
20Privacy and Personal Data
Thrift Kosova processes personal data in accordance with its Privacy Policy and applicable legislation.
Where voluntary identity verification is used, identification documents and related information must only be processed for the stated purposes and on the appropriate legal basis.
Processing of personal data in Kosovo is governed, among other legislation, by Law No. 06/L-082 on Protection of Personal Data.
The Privacy Policy is a separate document from these Terms.
21Third-Party Services
Thrift Kosova may use third-party services, including payment providers, couriers, hosting providers, analytics providers, verification providers and other technical services.
Availability of the Platform may depend in part on these providers.
Where a user enters into a direct relationship with such a provider, that provider's terms may also apply.
22Changes to the Platform and These Terms
Thrift Kosova may modify or improve the Platform and these Terms.
Where a change is material, we will make reasonable efforts to notify the user before the change takes effect where required by law.
Changes will not retroactively remove rights acquired through a transaction that has already been completed.
The current version and the date of the latest update will be available on the Platform.
23Complaints
Users may submit complaints regarding Thrift Kosova services through:

Thrift Kosova will handle complaints within the mandatory statutory timeframes. Where the relevant provisions of the Consumer Protection Law apply, a trader must respond to the consumer no later than 15 days after receiving the complaint.
Nothing in the internal complaints procedure removes the user's right to contact a competent authority, the relevant consumer-protection mechanism or a court.
24Governing Law and Disputes
These Terms and the use of Thrift Kosova are governed by the laws of the Republic of Kosovo.
The parties are encouraged to first attempt to resolve any dispute through the Platform's mechanisms or by contacting Thrift Kosova.
If the dispute cannot be resolved, it may be submitted to the competent court or authority under the laws of the Republic of Kosovo.
No provision of these Terms limits any mandatory consumer right relating to jurisdiction, legal remedies or legal protection.
Law No. 04/L-077 on Obligational Relationships applies to obligations falling within its scope and to relevant matters not otherwise regulated.

Kosovo's Law on Information Society Services requires an online service provider to make information such as its name, address, electronic contact details, business registration number and, where applicable, VAT identification number easily accessible.
26Language and Final Provisions
These Terms may be made available in more than one language.
The English version is provided for convenience. In the event of any inconsistency between the Albanian and English versions, the Albanian version shall prevail to the extent permitted by applicable law.
This does not limit a consumer's right to receive information in the official languages where required by law.
If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
